This policy explains how FDF Wizard handles personal and financial information, in accordance with the Protection of Personal Information Act, 2013 (POPIA). FDF Wizard processes highly sensitive financial information related to divorce and maintenance proceedings. We take this responsibility seriously.
The key point: FDF Wizard stores your matter data, uploaded documents, and account information securely on hosted server infrastructure so that you can save your work, return later, and generate the required output. Your information is protected by two-factor authentication, database encryption, and secure document storage.
POPIA (the Protection of Personal Information Act, Act 4 of 2013) is South Africa's data protection law. It governs how personal information is collected, stored, used, and shared. FDF Wizard processes personal information as part of preparing Financial Disclosure Forms and is subject to POPIA.
Responsible party: The responsible party, as defined by POPIA Section 1, is the entity that determines the purpose and means of processing personal information. The responsible party for FDF Wizard will be updated here once the operating entity is formally registered. In the interim, enquiries can be directed to info@fdfwizard.co.za.
Operator: The platform infrastructure is hosted and maintained by ART Technologies (Appanna Ganapathy), based in South Africa. ART Technologies acts as an operator under POPIA Section 1, processing personal information on behalf of FDF Wizard and in accordance with a formal services agreement. ART Technologies does not use your data for any purpose other than providing hosting, security, maintenance, and technical support for the FDF Wizard platform.
Data Processing Agreement: A formal agreement governs the relationship between FDF Wizard and ART Technologies. This agreement covers the scope of data processing, confidentiality obligations, security requirements, breach notification procedures, and data deletion on termination.
Your POPIA responsibilities: As the attorney or mediator using FDF Wizard, you are the responsible party under POPIA for your client's personal information. FDF Wizard provides a secure platform with appropriate safeguards, but the professional duty of care for client data within your practice remains yours. This includes ensuring you have lawful grounds to process your client's information and that you comply with your own professional body's data handling requirements.
Account information: name, email address, and login credentials required to create and manage your user account.
FDF client data (entered by the practitioner): names, identity numbers, residential addresses, dates of birth, marriage details, financial information including assets, liabilities, income, expenses, bank statement transaction data, and supporting document references. This is the information required by the court-prescribed Financial Disclosure Form.
Uploaded documents: financial, legal, and supporting documents required for preparation of a Financial Disclosure Form, including bank statements, valuations, payslips, and other annexures.
Matter and usage records: matter progress, saved forms, generated outputs, token usage, and audit trail records.
Technical information: login activity, system logs, and usage records required to operate and secure the platform.
Website contact: if you email us at info@fdfwizard.co.za, we receive your name and email address. This is used solely to respond to your enquiry.
Provide the service: create and manage user accounts, allow you to save and return to FDF matters, store uploaded documents for review and output generation, and process bank statement data for financial categorisation.
Manage access: manage subscriptions, tokens, and usage-based access to the platform.
Maintain the platform: provide technical support, maintain security, prevent misuse, and ensure auditability.
Your information is stored on secure server infrastructure hosted and managed by ART Technologies in South Africa. This includes your account details, matter data, uploaded documents, and usage records. Your information is retained so that you can log back in, continue working, review uploaded documents, and generate the required output.
Uploaded documents are stored securely and remain available after you log out or close your browser. This is necessary to support saved matters, multiple sessions, team access where applicable, and final output generation.
Access to user information is restricted to the following:
FDF Wizard product owner and authorised personnel: for product management, user support, and issue resolution.
ART Technologies (hosting and development provider): for server administration, database management, security maintenance, backups, and technical support. ART Technologies personnel operate under a formal services agreement that includes confidentiality obligations and non-disclosure terms.
No other party has access to your data. FDF Wizard does not sell, share, or provide user data to any third party for marketing or any purpose unrelated to operating the platform.
We use reasonable technical and organisational safeguards appropriate to the nature of the information processed:
Two-factor authentication (2FA): all user logins are protected by two-factor authentication.
Database encryption: sensitive personal information stored in the database, including names, identity numbers, and similar identifying information, is encrypted.
Secure document storage: uploaded documents are stored securely on ART Technologies' servers with controlled access.
HTTPS: all connections use TLS encryption. Data transmitted between your browser and the server is encrypted in transit.
Cloudflare: the domain is connected to Cloudflare for additional domain-level security, including DDoS protection and SSL management.
Environment separation: development and production environments are separated. Changes are tested before being applied to the live platform.
Backups: regular backups are maintained by ART Technologies as part of the hosting arrangement.
Hosting provider: ART Technologies, based in South Africa. See Section 5 for access details and Section 1 for the data processing arrangement.
Cloudflare: the domain uses Cloudflare for domain-level security. Cloudflare may process traffic data in accordance with its own privacy policy.
Bank statement conversion: FDF Wizard is building internal bank statement parsing to process bank statements within the platform. Where the platform uses a third-party service for bank statement conversion, the relevant bank statement or extracted data may be transmitted to that service for processing. FDF Wizard assesses the privacy, security, and POPIA position of any such service before integration. This section will be updated as the internal conversion capability is finalised.
Payment processing: where the platform integrates with payment gateways for subscription or token purchases, relevant payment information is shared with those providers only to the extent required. Payment providers operate under their own privacy and security terms.
The FDF Wizard application loads fonts from Google Fonts and a spreadsheet library from jsDelivr CDN. These services may collect anonymised usage data as described in their respective privacy policies. No client financial data is shared with these services.
FDF Wizard does not currently use cookies, tracking pixels, or analytics services. No browsing behaviour is tracked. No data is shared with advertising networks. If analytics are introduced in future, a cookie consent banner will be implemented and this policy will be updated.
User data is not sent to external AI tools or services. If AI processing is introduced in future, it will be handled internally and this policy will be updated to explain what data is processed, where, and what safeguards apply.
As a data subject, you have the right to:
Access: request confirmation of what personal information we hold about you.
Correction: request that we correct or update inaccurate personal information.
Deletion: request that we delete your personal information where we have no lawful reason to continue processing it.
Object: object to the processing of your personal information.
You may request deletion of your account or matter information, subject to legal, operational, or contractual limitations. To exercise any of these rights, contact info@fdfwizard.co.za.
We retain user information and uploaded documents for as long as reasonably necessary to provide the service, allow you to access your saved matters, meet operational requirements, comply with legal obligations, resolve disputes, and maintain appropriate records.
Email correspondence is retained for as long as necessary to respond to enquiries and manage the business relationship.
FDF Wizard is a professional tool designed for use by qualified attorneys, mediators, and paralegals. It is not intended for use by children (persons under the age of 18). We do not knowingly collect personal information from children.
Where child information appears in the FDF (for example, names and dates of birth of children of the marriage), this information is entered by the practitioner in the course of completing a court-mandated document.
This policy may be updated from time to time. The "Last updated" date at the top reflects the most recent revision. Significant changes will be communicated through the website.
